Terms of Service — Platform Operating Agreement

01. Acceptance of Terms

By accessing or utilizing Xpoudy (“the Platform”), creating an account, connecting sending mailboxes, or purchasing digital goods, you enter into a legally binding agreement with Xpoudy Inc. (“Xpoudy”, “we”, “us”). If you do not agree to these Terms, you must discontinue use of the Platform immediately.

02. Description of Services & Free Software License

Xpoudy grants you a revocable, non-exclusive, non-transferable, zero-subscription license to use our core cold outreach engine, including connecting unlimited mailboxes, participating in the decentralized peer-to-peer warmup network, orchestrating automated sequences, and tracking campaign interactions.

03. Peer-to-Peer Warmup Network Etiquette & Integrity

By enabling P2P warmup, your connected mailboxes participate in a mutual deliverability network with other verified senders. To maintain pristine sender reputations for all participants:

Strict DNS Authentication: Connected mailboxes must maintain valid SPF, DKIM, and DMARC configurations at all times.

Synthetic Dialogue Isolation: The network exclusively sends automated, AI-generated synthetic positive-sentiment emails between participating peers.

Zero Abuse Tolerance: Injecting spam, illicit solicitations, malicious links, or phishing payloads into the warmup network will trigger an immediate permanent ban.

04. Paid Add-on Services & Commercial Terms

All paid digital goods (lead intelligence credits, email hygiene validations, pre-warmed infrastructure) are subject to the Refund & Digital Goods Policy outlined herein. Prices are displayed in USD and are subject to change with advance notice on the Platform.

05. Limitation of Liability & Disclaimer of Warranties

The Platform is provided on an “as-is” and “as-available” basis without warranties of any kind. Xpoudy is not liable for indirect, incidental, punitive, or consequential damages, including loss of business opportunities, third-party email provider suspensions (such as Google Workspace or Microsoft 365 policies), or deliverability degradation caused by high spam complaints or unverified lead lists uploaded by users.
